Terms of Use

These Terms of Use ("Terms") govern your access to and use of MindStream, including the iOS app, Android app, and web application at mindstream.you (collectively, the "App"), operated by Lucid App Studios ("we," "our," or "us").

By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years of age to use MindStream. By using the App, you represent and warrant that you meet this requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

2. Your Account

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activity that occurs under your account
• You must provide accurate and complete information when creating your account
• You must notify us immediately of any unauthorized use of your account at hello@lucidappstudios.com
• We reserve the right to suspend or terminate accounts that violate these Terms

3. Subscriptions and Payments

MindStream offers a free tier and a paid Pro subscription.

MindStream Pro — Auto-Renewable Subscription

• Subscription name: MindStream Pro
• Subscription length: Monthly (renews automatically every month)
• Price: $7.99 per month
• Payment: Charged to your Apple ID, Google Play account, or payment method on file at confirmation of purchase
• Renewal: Your subscription automatically renews unless cancelled at least 24 hours before the end of the current billing period
• Cancellation (iOS): Manage or cancel in your Apple ID account settings at any time
• Cancellation (Android): Manage or cancel via Google Play → Subscriptions
• Cancellation (Web): Manage via your account settings in the App

All payments are processed by RevenueCat and the applicable platform (Apple App Store, Google Play, or Stripe). We do not store your payment information.

4. Acceptable Use

You agree not to use MindStream to:

• Violate any applicable law or regulation
• Transmit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Attempt to gain unauthorized access to our systems or other users' accounts
• Reverse-engineer, decompile, or otherwise attempt to extract source code from the App
• Use the App in any way that could damage, disable, or impair its functionality
• Use automated tools or bots to interact with the App without our written consent
• Circumvent any usage limits or access controls

5. Your Content

You retain full ownership of the Thoughts, notes, and other content you create in MindStream ("Your Content"). By using the App, you grant us a limited, non-exclusive license to store, process, and transmit Your Content solely to provide the App's functionality.

We do not claim any ownership rights in Your Content. We will never sell your content or use it for advertising purposes.

You are solely responsible for Your Content and represent that you have the rights necessary to upload it.

6. AI Features and Third-Party Processing

MindStream uses Google Gemini to power AI features. When you use AI features (Smart Capture, Tidy Up, Brain Search, Flow Mode, Morning Briefing), the text of your Thoughts is transmitted to Google's servers for processing.

By using AI features, you consent to this processing. You can withdraw consent and disable AI features at any time in Settings → Data & Privacy.

AI-generated outputs (summaries, classifications, suggestions) are provided for convenience and may not always be accurate. You should not rely on AI outputs for critical decisions.

7. Intellectual Property

The App, including its design, code, branding, and all content we create (excluding Your Content), is owned by Lucid App Studios and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

"MindStream" and the MindStream logo are trademarks of Lucid App Studios.

9. Limitation of Liability

To the maximum extent permitted by law, Lucid App Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, or loss of goodwill.

Our total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the data practices described in the Privacy Policy.

11. Termination

You may stop using the App and delete your account at any time via Settings → Delete Account.

We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our sole discretion.

Upon termination, your right to use the App ceases immediately. Sections 5, 7, 8, 9, and 12 survive termination.

12. Governing Law

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in Washington State.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date at the top of this page. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
